Jason Sinclair, 28, appeared at Falkirk Sheriff Court last Thursday having pleaded guilty to driving while unfit through drugs on M80, Junction 7, Haggs on November 2 last year.

Sinclair had both cannabis and cocaine in his system. The charges stated he had seven milligrams of delta-9-tetrahydrocannibinol in his blood, when the legal limit is 2 milligrams, and 217 milligrams of benzoylecgonine per litre of blood, when the legal limit is 50 milligrams.

He also admitted cannabis possession.

Procurator fiscal depute Mandy Jones said: “Police were on mobile patrol, travelling southbound to Haggs when they saw a car with a single male occupant. They carried out a routine check at 8.10am and noted a strong smell of cannabis coming from the car.

"The accused provided a sample of saliva and it tested positive for cannabis and cocaine. No drugs were found on the accused, but a quantity of green herbal substance was found in the car – four grams of cannabis worth £40.”

The court heard Sinclair, a machine operator, had turned to drugs to cope with the death of his grandfather. It was stated he had referred himself to Change Grow Live and had not taken drugs or alcohol since.

Sheriff Alison Michie placed Sinclair, 13 St Serf’s Walk, Alva, on a supervised community payback order for 12 months with the condition he complete 165 hours of unpaid work within that time and attend the Clackmannanshire group for road offenders.

He was also banned from driving for 16 months.
